1. Introduction & Acceptance
Welcome to Burner, a virtual phone number and call forwarding platform. Burner allows you to purchase virtual phone numbers and forward incoming calls to your personal devices, keeping your real number private.
Burner is operated from England, United Kingdom. By accessing or using Burner, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, please do not use our service.
2. Service Description
Burner is a software platform that enables users to:
- Purchase virtual phone numbers in the US, Canada, UK, Australia, New Zealand, and South Africa
- Forward incoming calls from virtual numbers to verified personal devices
- Manage multiple virtual numbers simultaneously
- View call history with detailed duration and cost information
- Top up a prepaid wallet to pay for numbers and call forwarding
The service is provided "as is" and is subject to ongoing changes, updates, and improvements as we continue development.
3. Content Usage & Ownership
Your Data: You retain ownership of all data associated with your account, including call recordings (if enabled), call logs, and forwarding configurations. By using Burner, you grant us a limited licence to process and store this data solely for the purpose of providing our services to you.
Call Recordings: If call recording features are available and enabled, recordings are stored on your behalf. You are solely responsible for the use, distribution, and deletion of any call recordings.
Restrictions: You may not use Burner to:
- Resell or redistribute virtual numbers or call forwarding as a separate service
- Scrape, copy, or systematically extract platform data
- Circumvent usage limits or platform restrictions
- Use virtual numbers for fraudulent or deceptive purposes
4. User Accounts & Responsibilities
4.1 Account Creation
Burner uses Google OAuth for authentication. By signing in with your Google account, you authorise us to access your basic profile information (name, email address, and profile picture) as detailed in our Privacy Policy.
4.2 Account Security
You are responsible for maintaining the security of your Google account used to access Burner. Please report any unauthorised access immediately.
4.3 Forwarding Destinations
You must verify ownership of any phone number you add as a forwarding destination by completing an OTP (one-time password) verification process. You may only add phone numbers that you own or have authorisation to use.
5. Call Recording
If call recording functionality is available and enabled on your account, it is your sole responsibility to inform the other participant(s) on any call that the call is being recorded. You must obtain any required consent before recording begins.
Recording laws vary significantly by jurisdiction. Many jurisdictions require all-party consent (meaning every participant must be informed and agree to the recording), while others permit one-party consent. You are responsible for understanding and complying with all applicable laws regarding call recording, including but not limited to:
- Federal and state wiretapping laws (e.g., US two-party consent states such as California, Florida, and others)
- UK and EU regulations including GDPR requirements for processing voice data
- Canadian federal and provincial privacy legislation
- Australian state and territory surveillance and listening devices legislation (several states require all-party consent)
- New Zealand's Privacy Act 2020 and Crimes Act interception provisions
- South Africa's Regulation of Interception of Communications Act (RICA)
- Any other applicable local, national, or international laws
Burner does not accept any liability for your failure to inform call participants of recording or to obtain required consent. By enabling call recording, you acknowledge that you understand these obligations and accept full responsibility for compliance.
6. Acceptable Use
You agree not to use Burner to:
- Violate any applicable laws or regulations
- Make threatening, harassing, or abusive calls
- Engage in caller ID spoofing for fraudulent purposes
- Conduct telemarketing, robocalling, or spam calls
- Use virtual numbers for illegal activities
- Interfere with or disrupt the service or its infrastructure
- Attempt to reverse-engineer or extract our platform technology
We reserve the right to remove any numbers and to suspend or terminate accounts that violate our policies, without refund.
7. Intellectual Property
7.1 Platform IP
The Burner platform, including its design, code, and branding, is our intellectual property and is protected by copyright and other laws. You may not copy, modify, or distribute any part of our platform without permission.
7.2 Telephony Infrastructure
Virtual phone numbers are leased, not owned. Numbers remain the property of the underlying telecommunications providers and may be reclaimed if your account is terminated or the number is released.
8. Service Availability
We strive to provide reliable service, but cannot guarantee uninterrupted availability. The platform may experience:
- Temporary outages or downtime for maintenance
- Call quality issues dependent on telecommunications networks
- Changes to features or functionality with notice
- Number availability variations by country and region
Our services depend on third-party telephony providers and cloud infrastructure which may have their own availability limitations. Burner is not a replacement for emergency telephone services.
9. Limitation of Liability
Burner is provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the fullest extent permitted by law, Burner and its operators shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:
- Use or inability to use the service
- Missed, dropped, or failed calls
- Call recording failures or data loss
- Telecommunications network outages
- Unauthorised access to your account
- Loss of virtual phone numbers
10. Privacy & Data Protection
Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which is incorporated into these Terms of Service by reference.
We comply with UK GDPR (General Data Protection Regulation) and the Data Protection Act 2018, and, where they apply to you, with local data protection laws in the countries we serve — including Canada's PIPEDA, Australia's Privacy Act 1988, New Zealand's Privacy Act 2020, and South Africa's Protection of Personal Information Act (POPIA). You have rights regarding your personal data, including the right to access, rectify, erase, and port your data, as detailed in our Privacy Policy.
11. Wallet & Payments
Burner operates on a prepaid wallet system. Payment processing is handled securely by Stripe. By using Burner, you agree to:
- Add funds to your wallet before purchasing numbers or receiving forwarded calls
- Pay the applicable monthly rental fee for each virtual number
- Pay per-minute charges for forwarded calls, billed in one-minute increments rounded up
- Provide accurate billing information
Virtual numbers renew automatically each month. If your wallet balance is insufficient at renewal time, the number may be released. Wallet funds are non-refundable except where required by law.
12. No Refunds
All payments made to Burner are final and non-refundable. This includes wallet top-ups, virtual number setup fees, monthly number rental fees, and per-minute call forwarding charges.
Specifically, we do not provide refunds, credits, or exchanges for:
- Unused wallet balance, whether or not your account remains active
- Virtual numbers you no longer wish to use, or that you release before the end of a paid rental period
- Partial months of number rental — rental fees are charged for the full month and are not pro-rated
- Calls that were connected, including calls of poor quality, calls answered by voicemail, or calls you did not intend to receive
- Service outages, downtime, or telecommunications network failures
- Numbers released because your wallet balance was insufficient at renewal time
- Accounts suspended or terminated for breach of these Terms of Service
Wallet funds have no cash value and cannot be withdrawn, transferred to another account, or exchanged for money. Any remaining balance is forfeited when your account is closed or terminated.
At our sole discretion, we may issue a wallet credit for billing errors or failed calls that were charged in error. Any such credit is applied to your Burner wallet only, is not a cash refund, and does not create an obligation to provide credits in future.
Statutory rights: Nothing in this section affects any rights you have that cannot be excluded under applicable law, including consumer protection law in England and Wales or in your country of residence. Where you are a consumer with a statutory right to cancel, you acknowledge that by topping up your wallet or purchasing a virtual number you request that the service begins immediately, and that your right to cancel is lost once the service has been fully performed.
13. Changes to Terms
We reserve the right to update or modify these Terms of Service at any time. When we make changes, we will update the "Last Updated" date at the bottom of this document. For material changes, we will make reasonable efforts to notify users through the platform.
Your continued use of Burner after any changes constitutes acceptance of the updated terms. If you do not agree with the new terms, please stop using the service.
14. Termination
You may delete your account at any time through your account settings. We may suspend or terminate your access to Burner at any time, with or without notice, for any reason, including but not limited to violations of these Terms of Service.
Upon termination, your right to use the service will immediately cease. All virtual numbers will be released and any remaining wallet balance will be forfeited unless a refund is required by law. We may retain certain data as required by law or for legitimate business purposes as outlined in our Privacy Policy.
15. Governing Law & Disputes
These Terms of Service are governed by the laws of England and Wales. Any disputes arising from these terms or your use of Burner shall be subject to the exclusive jurisdiction of the courts of England and Wales.
